Mend is not a medical device and does not provide medical advice. Always follow your surgeon's instructions. In an emergency, call 911.

1. Acceptance of Terms

By accessing or using Mend ("the App"), you agree to be bound by these Terms of Use. If you do not agree, do not use the App. These terms apply to all users of the App.

2. Description of Service

Mend is a personal post-surgical recovery organization tool. It helps users track medications, therapy tasks, pain levels, and recovery progress following surgery. Mend is intended to supplement — not replace — instructions provided by your healthcare team.

3. Medical Disclaimer

This is the most important section. Please read it carefully.

Mend is not a medical device, does not provide medical advice, diagnosis, or treatment, and is not intended to be a substitute for professional medical judgment. Specifically:

The AI-generated check-ins, briefings, and summaries are for general informational and motivational purposes only. They are not medical advice.
Medication schedules pre-populated in the App are examples only. Your actual prescribed medications, doses, and schedules may differ. Always follow your doctor's written discharge instructions.
The Oxycodone dosing warning is a general safety reminder. It does not account for your individual medical situation. Follow your surgeon's specific prescribing instructions.
If you experience a medical emergency, call 911 immediately. Do not consult the App.
Mend is not a substitute for contacting your surgeon, nurse, or other healthcare provider when you have clinical questions or concerns.

Your use of Mend does not create a doctor-patient relationship or any other medical relationship.

4. User Responsibilities

By using Mend, you agree to:

Use the App only as a personal organizational tool, not as a source of medical advice
Verify all medication information against your actual discharge instructions from your healthcare provider
Keep your emergency contact and patient information accurate and up to date
Not share your device or the App in a way that could compromise another person's health information
Immediately seek emergency medical care when your symptoms warrant it, regardless of what the App indicates

5. AI Features

Mend includes optional AI-powered features (daily check-in, caregiver briefing, appointment summary, PDF parsing) powered by Anthropic's Claude API. These features:

Generate responses based on the data you have entered and are not reviewed by medical professionals
May occasionally produce inaccurate, incomplete, or inappropriate responses
Are intended for general encouragement and organization, not clinical decision-making
Should not be relied upon for dosing decisions, diagnosis, or emergency guidance

Use of AI features is entirely optional. All core App functionality operates without them.

6. Limitation of Liability

To the fullest extent permitted by applicable law, Mend and its operators shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

Your use of or reliance on the App
Any medical decisions made based on information in the App
Loss of data due to browser clearing, device loss, or App reset
Inaccurate AI-generated content
Failure of notification reminders to fire
Any interruption or unavailability of the App or its AI features

Your use of the App is at your own risk. The App is provided "as is" and "as available" without warranties of any kind, express or implied.

7. No Warranty

Mend makes no warranty that the App will be error-free, uninterrupted, secure, or that any information provided — including AI-generated content — is accurate, complete, or appropriate for your specific medical situation.

8. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy describes how your data is handled — in summary, it stays on your device.

9. Intellectual Property

The Mend name, logo, design, and application code are proprietary. You may not copy, reproduce, distribute, or create derivative works without express written permission.

10. Modifications to the App and Terms

We reserve the right to modify or discontinue the App at any time. We may update these Terms as the App evolves. The "Last updated" date at the top of this page will reflect changes. Continued use of the App after changes constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of the District of Columbia, United States, without regard to conflict of law principles.
